Terms and Conditions

By using our website at apexblackcar.com, or by requesting, purchasing, or booking any service through our website, mobile platform, telephone, email, or any third-party booking system, you (the “Client”) agree to be bound by these Terms and Conditions. The Client must be at least eighteen (18) years of age to book a service.
1. Wait Time
Point-to-Point Reservations
Wait time is charged at $7.00 per five-minute increment after the grace period ends. The grace period is seven minutes beyond the scheduled pickup time.
Airport Pickups: Domestic Flights
A thirty-minute grace period applies from the actual domestic flight arrival time. Apex tracks all flights in real time, and your driver adjusts automatically.
Airport Pickups: International Flights
A sixty-minute grace period applies from the actual international arrival time to account for customs and immigration processing.
Bus, Train, and Ferry Pickups
These schedules cannot be monitored in real time. Time tracking begins at the scheduled pickup time. Contact Apex dispatch immediately if your connection is delayed.
2. Vehicle-Specific Terms
Sedans and SUVs — Point-to-Point
Billed at the flat quoted rate for point-to-point service.
As-Directed (Hourly) Bookings — All Vehicles
All as-directed bookings carry a minimum of three (3) hours regardless of vehicle type. Billing is tracked garage to garage. Fractions of an hour beyond the minimum are rounded up to the next half-hour.
Stretch Limousine
Minimum booking of three (3) hours on weekdays and four (4) hours on weekends and holidays. All billing is garage to garage.
Passenger Capacity
Rated capacities: Lincoln Continental (3), Mercedes-Benz S 580 (3), Cadillac Escalade ESV (6), Mercedes-Benz Sprinter VIP (10), Lincoln Stretch Limousine (8), Executive Motor Coach (55). Child safety seats count toward the passenger total.
3. Booking Requirements
- Clients must be at least eighteen (18) years of age to make a booking.
- A parent or legal guardian must book on behalf of any minor.
- The number of passengers may not exceed the rated vehicle capacity.
- Third-party bookings (travel agents, corporate managers) bind the Client to these Terms.
4. Cancellation Policy
Sedan and SUV Reservations
Cancellations must be made at least twelve (12) hours before pickup for local Massachusetts trips, and at least twenty-four (24) hours in advance for out-of-state reservations. Late cancellations are charged the full fare plus the mandatory 20% gratuity.
Sprinter VIP, Minibus, and Motor Coach Reservations
Cancellations must be made at least seven (7) days in advance.
FIFA World Cup 2026 and Special Event Reservations
All World Cup 2026 bookings and special event reservations are non-refundable within seventy-two (72) hours of the scheduled pickup time. No exceptions are made within this window.
Flight Delays
Flight delays are never charged. Apex provides complimentary real-time flight tracking on all airport pickups.
5. No-Show Policy
A no-show fee equals the full anticipated trip fare plus applicable wait time plus the mandatory 20% gratuity. If you cannot locate your driver, call (844) 209-5466 immediately.
6. Client Conduct
- Chauffeurs have the right to prohibit smoking, vaping, and inappropriate conduct inside the vehicle at all times.
- Physical or verbal abuse of any Apex chauffeur or staff will result in immediate termination of service, forfeiture of all fares, and may result in a permanent ban and legal action.
- Apex vehicles are smoke-free at all times, including tobacco, cannabis, and electronic cigarettes.
- Clients may not bring firearms, controlled substances, or any illegal items into an Apex vehicle.
7. Alcohol Service and Liability
Apex offers champagne and beverage service as an optional add-on. Apex will not serve alcohol to any passenger under twenty-one (21) or to any visibly intoxicated passenger. The Client assumes full legal responsibility for the alcohol consumption of all passengers.
8. Damage to Vehicles and Property
Damage charges: $100.00 per carpet or seat burn, $250.00 for additional cleaning or minor damage, actual costs for damage exceeding $250.00, and a $300.00 minimum for biohazard cleaning. Damage charges are assessed within forty-eight (48) hours and charged to the card on file.
9. Lost and Found
Apex is not liable for personal belongings left in a vehicle, but will make reasonable efforts to recover and return lost items. Contact us within twenty-four (24) hours at reservations@apexblackcar.com or (844) 209-5466. Recovered items are held for fourteen (14) days.
10. Holiday Surcharges
A $40.00 holiday surcharge applies to all trips on: New Year’s Day, Presidents Day, Easter Sunday, Memorial Day, Independence Day, Labor Day, Thanksgiving Day, and Christmas Day.
11. Affiliate Network and Subcontracting
Apex may contract with vetted affiliated companies from its worldwide affiliate network. Apex remains your single point of contact and assumes responsibility for the quality of all affiliate-fulfilled rides. All affiliates sign the Apex Affiliate Partner Agreement.
12. Force Majeure
Apex is not liable for any failure or delay resulting from severe weather, natural disasters, government orders, road closures, acts of terrorism, pandemic or public health emergencies, or major infrastructure failures. Force majeure events do not entitle the Client to a cash refund of any non-refundable deposit or cancellation fee already charged.
13. FIFA World Cup 2026 Special Terms
- All World Cup 2026 transfer bookings are non-refundable within seventy-two (72) hours of the scheduled pickup time.
- World Cup match-day transfers carry flat rates with zero surge pricing on all seven Boston match days.
- Corporate hospitality groups and delegation transport are subject to separate written agreements. Contact worldcup@apexblackcar.com.
14. Rates, Fees, and Additional Charges
All fares are flat rates quoted at the time of booking. Apex does not apply surge pricing at any time, including on FIFA World Cup 2026 match days, holidays, peak hours, or weekends.
- Fuel surcharge: 7% applied to the base fare on all services.
- Same-day service fee: $50.00.
- Late-night airport surcharge: $25.00 for pickups between 12:00 AM and 3:00 AM.
- Holiday surcharge: $40.00 (see Section 10).
- Wait time and stop time: $7.00 per five-minute increment beyond the grace period.
15. Gratuity
A twenty percent (20%) gratuity is automatically added to the base fare on every booking without exception. It is mandatory, non-negotiable, and non-waivable under any circumstances.
16. Billing and Payment
Apex operates exclusively on a prepaid basis. All services must be paid in full at the time of booking. Accepted payment methods: American Express, Discover Card, MasterCard, and Visa. Corporate account holders with approved signed agreements may request services on net-30 monthly terms.
17. Limitation of Liability
Apex’s maximum liability for any claim arising from a single booking shall not exceed the total base fare paid for that specific booking, excluding gratuity, surcharges, and add-ons. Apex is not liable for any indirect, incidental, special, consequential, or punitive damages of any kind.
18. Website Acceptable Use
By using apexblackcar.com, the Client agrees not to attempt unauthorized access to any computer system, distribute malware, interfere with other users’ accounts, send spam, or infringe on Apex’s intellectual property rights.
19. Electronic Acceptance
By completing a booking, the Client confirms they have read, understood, and accepted these Terms in full. Electronic acceptance constitutes a legally binding agreement under the E-SIGN Act and M.G.L. c.110G.
20. Dispute Resolution and Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts. Disputes shall be resolved through binding arbitration administered by the American Arbitration Association in Boston, Massachusetts. Both parties agree that any dispute resolution proceeding will be conducted only on an individual basis and not in a class, consolidated, or representative action.
